These Terms of Service ("Terms") govern your use of the mobile applications, websites, and related services (collectively, the "Apps") provided by Two Flamingos Digital Ltd ("Two Flamingos", "we", "our", or "us").
By downloading, accessing, or using any of our Apps, you agree to these Terms. If you do not agree, please do not use our Apps.
1. About Our Apps
Two Flamingos develops interactive educational and entertainment experiences for children and families.
Our Apps may include interactive books, narrated stories, music, illustrations, animations, games, and optional augmented reality ("AR") experiences.
The features available may differ between Apps.
2. Intended Audience
Our Apps are designed for children and families.
Parents and guardians are responsible for supervising children's use of our Apps where appropriate.
3. Camera and Augmented Reality Features
Some Apps include optional augmented reality features that require access to your device's camera.
Granting camera permission is optional. If camera access is not granted, the rest of the App will continue to function unless a particular feature specifically requires the camera.
Some AR experiences are powered by Snap Camera Kit and may also be subject to Snap's applicable terms and policies.
4. Intellectual Property
All content included in our Apps - including stories, text, illustrations, artwork, animations, music, narration, sound effects, software, graphics, trademarks, and other materials - is owned by or licensed to Two Flamingos Digital Ltd and is protected by applicable intellectual property laws.
You may use our Apps for your personal, non-commercial use only.
You may not copy, reproduce, distribute, modify, reverse engineer, or otherwise use any part of our Apps except as permitted by applicable law.
5. Acceptable Use
You agree not to:
use our Apps for any unlawful purpose;
interfere with the operation or security of our Apps;
attempt to gain unauthorized access to our Apps or related systems;
use our Apps in any way that may damage or impair their operation.
6. Availability
We strive to keep our Apps available and functioning correctly, but we cannot guarantee uninterrupted or error-free operation.
We may modify, update, suspend, or discontinue features at any time.
7. Disclaimer
Our Apps are provided "as is" and "as available" to the fullest extent permitted by law.
We do not guarantee that our Apps will always be available, error-free, or compatible with every device.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Two Flamingos Digital Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to the use of our Apps.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
9. Arbitration
This agreement to arbitrate is between Two Flamingos Digital Ltd, all of Two Flamingos Digital Ltd's users, and all of Two Flamingos Digital Ltd's vendors and third party service providers, including the providers of any underlying technology.
Where permitted by applicable law, any dispute arising out of or relating to these Terms or the use of our Apps shall be resolved through binding arbitration rather than court proceedings, except where applicable law provides otherwise or where an individual claim may be brought before a small claims court.
Nothing in this section limits any rights that cannot legally be waived under applicable consumer protection laws.
10. Privacy
Your use of our Apps is also governed by our Privacy Policy.
Some Apps use anonymous analytics to help us understand how our Apps are used and to improve their performance.
Apps that include augmented reality features may use Snap Camera Kit or other technology providers to deliver those experiences.
Please refer to our Privacy Policy and any in-app privacy notices for additional information.
11. Changes to these Terms
We may update these Terms from time to time.
The updated version will become effective when published on our website. The "Last Updated" date above indicates when these Terms were most recently revised.
12. Governing Law
These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws in your country of residence apply.
